2. PERSONAL DATA WE PROCESS

2.1. Personal data from your application

The information processed as part of the recruitment process is required for us to contact you and to determine whether you are the right candidate for the vacant position. Information provided to us will be used to consider your application and in connection with subsequent employment.

In order to process your application, we will process the information appearing from your application, your CV and any enclosed documents. This typically includes the following information (the list is non-exhaustive): name, address, date of birth, gender, phone number, email address, educational background, professional qualifications, career history, language qualifications and other relevant qualifications and written recommendations/references, links to your professional profiles available in the public domain e.g. LinkedIn, Twitter, GitHub, Facebook, etc.

2.2. Personal data from your social media

We specifically consider each applicant's qualifications in relation to the open position. This is done manually. When recruiting for positions with us, it may be relevant to obtain additional information from the Internet, including social media, e.g. LinkedIn, GitHub, StackOverflow, Facebook, Instagram, Twitter, etc. We do that in order to determine if your profile suits our business and the specific position.

2.3. Personal data from job interviews

Once we have read the applications, we will select candidates for job interviews. The candidates that are not selected for an interview will be notified.

During the recruitment process, we conduct job interviews focusing on both your professional and your personal qualifications, the job content and our business as a workplace. We will make a note of some of the information disclosed during the interview(s) for the purpose of the final evaluation of the applicants for the position. We will only use relevant information when determining whether to offer you a job.

2.4. Personal data from tests

When recruiting for certain positions, you may be invited to take a test. We will always consider whether it is relevant that you take such test in relation to the relevant position. The purpose of the test is to evaluate your qualifications as a potential employee and to consider whether your profile suits our business and the specific position. The test will never stand alone but will be part of the general basis for selecting the right person for the position.

2.5. Personal data from other sources

We are working closely with third parties including business partners, Applicant tracking systems, sub-contractors in technical, professional, payment and other services, advertising networks, analytics providers, search information providers, credit reference agencies, and professional advisors. We may receive information about you from them for the purposes of our recruitment services and ancillary support services.

We may combine this information with the information you give to us and the information we collect about you. We may use this information and the combined information for the purposes set out below (depending on the types of information we receive).

2.6. Special and/or sensitive personal data

Our website and/or service does not intend to collect data about website visitors under the age of 16 unless they have parental or guardian consent. However, we cannot check whether a visitor is older than 16. We therefore advise parents to be involved in the online activities of their children, in order to prevent data about children from being collected without parental consent. If you are convinced that we have collected personal information about a minor without this permission, please contact us at is@vpteam.com.ua and we will delete this information.

We can also register information about your gender, age or nationality. It is optional, whether you want to provide that information. We process such information in order to comply with our diversity policy. Our legal basis for processing is our legitimate interests in complying with diversity requirements and preserving a culture of diversity, see Article 6 (1)(f) of the General Data Protection Regulation.

3. PURPOSE AND LEGAL BASIS OF PROCESSING YOUR DATA

Our legal basis for the processing of personal data is our legitimate business interests, described in more detail below, although we will also rely on contract, legal obligations and consent for specific uses of data. We will rely on a contract if we are negotiating or have entered into a placement agreement with you or your organization or any other contract to provide services to you or receive services from you or your organization. We will rely on legal obligation if we are legally required to hold information on to you to fulfill our legal obligations. We will rely on consent for particular uses of your data; you will be asked for your express consent, if legally required. Examples of when consent may be the lawful basis for processing include permission to introduce you to a client (if you are a candidate).

3.1. Our legitimate business interests

As a recruitment business and recruitment agency, we introduce candidates to clients for permanent employment, temporary worker placements or independent professional contracts. The exchange of personal data of our candidates and our client contacts is a fundamental, essential part of this process.

In order to support our candidates’ career aspirations and our clients’ resourcing needs we require a database of candidate and client personal data containing historical information as well as current resourcing requirements.

Twice a year, we also deliver detailed market analytics in form of spreadsheets and diagrams. We may use such information as your salary expectations, your experience, your gender, your age, your nationality, for that purpose. It will be presented in generalized statistical manner and will never be linked to your name, email, address, phone number, or any social media.

To maintain, expand and develop our business, we need to record the personal data of prospective candidates and client contacts. Due to the nature of our business, we will never store your personal data for a period longer than five (5) years without contacting you in this time to receive explicit consent.

To deliver our ancillary services we need to contact candidates on a regular basis, through various routes such as email, phone, job alerts and other relevant notifications.

3.2. Legal basis

In general, we use Article 6(1)(b) and Article 6(1)(f) of the General Data Protection Regulation as the legal basis for processing, because we need to process this information in order to determine whether you are the right candidate for the position.

We use Article 6(1)(f) or Article 9(2)(e) of the General Data Protection Regulation as the legal basis for processing when we obtain information about you from your social media. We may also, depending on the circumstances, use your consent, according to Article 6(1)(a) and Article (9)(2)(a) of the General Data Protection Regulation.

4. COOKIES AND OUR WEBSITE

4.1. Cookies

Our website uses cookies to distinguish you from other users of our website. This helps us to provide you with a good experience when you browse our website and also allows us to improve our site. We use cookies with a purely technical functionality. These ensure that the website works properly and that, for example, your preferred settings are remembered. These cookies are also used to make the website work properly and to optimize it.

4.2. Use of the website

Access to the website and use is strictly personal. You will not use this website and the data and information provided on it for commercial, political or publicity purposes, or for any commercial offers and in particular not for unsolicited electronic offers.

All brands, images, texts, comments, illustrations, images, video images, sounds, as well as all technical applications that can be used to make the website function and more generally all parts used on this site are protected by law by intellectual property rights. Any reproduction, repetition, use or modification, in any way whatsoever, of all or part of it, including technical applications, without the prior written consent of the controller, is strictly prohibited. If the administrator does not immediately take action against any infringement, this cannot be construed as tacit consent or waiver of legal proceedings.

5. HOW WE KEEP YOUR DATA

We take the protection of your data seriously and take appropriate measures to prevent misuse, loss, unauthorized access, unwanted disclosure and unauthorized changes.

Your personal data will not be kept longer than necessary to fulfil the purposes for which it was collected. When your personal data is no longer needed, we will ensure that it is deleted in a secure manner.

If you are not offered the position you applied for, we will delete any information registered about you within 6 months. The purpose of the storage is to document the recruitment process and the reason for not offering you the position.

If you are employed with us, we will retain the information from the recruitment process as part of your employee portfolio during your employment in order to document your employment history. You will receive separate information in this regard in connection with your employment.

In certain situations, we would like to keep your application even though it has been turned down for the purpose of recruitment at a later time. If we want to keep your data, we will ask for your consent. We will keep your application for 5 years for this purpose.

6. SHARING YOUR PERSONAL DATA WITH THIRD PARTIES

We share your personal data with various third parties if this is necessary for the execution of the agreement and to comply with our legal obligations.
